Appealing a NYC parking ticket decision: the 30-day second chance

• Only the registered owner, the driver, or an authorized representative of either (such as an attorney) may appeal.
• The deadline is 30 calendar days from the hearing decision date — not from when you read the email.
• Appeals are requested by mail only, on the official appeal application form (PVO-0100). There is no online appeal filing.
• You may request an in-person appeal by checking the box on the form; otherwise it is decided on the papers.

The Appeals Panel only reviews correct and complete applications. Send, for each plate:

• The completed, signed appeal application.
• The original judge's decision.
• A copy of the ticket(s) or Notices of Liability.
• Copies of all evidence submitted at the original hearing — the Board reviews what the judge saw; an appeal is not a place to introduce a brand-new case.
• Keep a full copy of everything for your records.

Your strongest appeals argue the judge misapplied a rule to the evidence already in the record — for example, a required-element defect that was documented but not addressed.

DOF itself suggests considering payment after a guilty decision, because penalties and interest can keep accruing during the appeal, and $350+ of judgment debt exposes the vehicle to booting. Paying does not hurt the appeal:

• If the Board reduces or reverses the decision after you paid, DOF automatically refunds the difference within 30 days to the person who filed the appeal.
• Once the appeal decision issues, you get 30 days from that decision to pay with no additional penalties.
• If you skip a scheduled in-person appeal, it is treated as abandoned and the original decision stands.

• Affirm (uphold), modify (often a reduced fine), or reverse (dismiss) the decision — or send the case back for a completely new hearing.
• The determination is mailed to you; expect the decision on the DOF's stated timelines (the Board's decision is sent within about 30–60 days).
• Past the Appeals Board, the remaining path is an Article 78 proceeding in New York Supreme Court (60 Centre Street, New York County) — a real lawsuit, usually only worth it for large commercial exposure. See is a lawyer worth it.
